Decide Terms

1. About Decide and these Terms

Decide (also shown as “Decide: What Matters”) is an iPhone app from DOURO VENTURES LTD (“Douro Ventures”, “we”, “us”). It helps you protect time and attention: you choose the areas of your life that matter, choose the apps that can wait, and start or schedule periods of protection. During protection, iPhone sets the chosen apps aside and, when you open one, shows you what you chose instead. Mini Break lets you use one protected app for a few minutes while everything else stays protected. Protection is a decision, not a lock: you can always end it.

These Terms cover our plans and what Decide does and does not do. Please read them before you buy a plan; they are linked from the purchase screen, from Settings in Decide and at getdecideapp.com.

2. Apple’s Standard EULA

Decide is distributed through Apple’s App Store. Your licence to use the app is governed by Apple’s Licensed Application End User License Agreement (the “Apple Standard EULA”), available in the App Store; these Terms do not change it. Apple is not a party to these Terms. Apple handles prices, billing, renewals, refunds and the restoring of purchases through your Apple Account.

3. What Decide does, and what we are responsible for

Protection needs your permission to use Apple’s Screen Time technologies on your own iPhone. iPhone asks for it the first time you choose what can wait; you can withdraw it at any time in iPhone Settings, after which Decide can no longer protect, although your configuration is kept.

Protection depends on iOS. Operating-system behaviour, device state, software defects, changes made by Apple and other circumstances outside our control can delay, interrupt or prevent protection, or delay its restoration after a Mini Break. Decide tells you when it cannot yet confirm that protection is in place or restored. We do not guarantee that Decide will operate without interruption or error, or that any Apple technology, device feature or third-party app will keep working the same way.

Decide is a tool for managing your own attention. It is not a parental-control, security, emergency, medical or safety-critical system, and it must not be relied on where a failure to restrict or restore access could cause harm. Decide is a consumer app; if you use it in connection with a business or profession, we are not responsible for business losses.

Nothing in these Terms excludes or limits any liability, consumer right or remedy that cannot lawfully be excluded or limited.

4. Free setup, paid protection

Decide is free to download, set up and configure. Starting or scheduling protection, including Mini Break, requires an unlock: an active Monthly or Yearly subscription, or Lifetime Access. If a subscription ends, Decide stops protecting the next time it runs, until it is unlocked again; your areas, selected apps and schedules stay on your iPhone.

5. Monthly and Yearly subscriptions

Monthly and Yearly are auto-renewing subscriptions bought through Apple, at the price and for the period shown when you confirm the purchase. Subscriptions renew automatically until you cancel. Cancel at any time in your Apple Account settings, at least 24 hours before the current period ends. Cancelling stops future renewals; the paid period you are in continues until it ends, unless the purchase is refunded or revoked.

Where Apple says you are eligible, Yearly begins with a free trial of seven days. The trial length and the price you will pay afterwards are shown before you confirm; unless you cancel at least 24 hours before the trial ends, the subscription converts to the paid Yearly subscription at that price. Deleting or resetting Decide does not cancel an Apple subscription.

6. Lifetime Access

Lifetime Access (“Lifetime”) is a one-time purchase: you pay once, nothing renews, and it has no scheduled expiration date. It unlocks the paid functionality included in Decide’s Lifetime plan when you buy it; in Decide 1.0 that is starting and scheduling protection, including Mini Break — everything else in Decide is free.

While we continue to offer Decide, we will not remove or materially reduce the paid functionality your Lifetime purchase unlocked. Within that, we remain free to change Decide — to redesign, improve or replace features and to change how protection works — as long as what you unlocked is preserved in substance. The only exceptions are a change required by law or regulation, a change reasonably necessary to address a material security risk, or a material change, restriction, withdrawal or incompatibility in Apple’s technology, platform rules or distribution outside our reasonable control; even then, we change only what that cause reasonably requires.

A renamed, rebranded or successor app that takes Decide’s place with substantially the same paid functionality is still Decide for this purpose: your Lifetime purchase carries over to it without another charge — including after Decide itself is discontinued. Lifetime does not extend to other products we may offer, even where they include similar features.

Lifetime does not mean that Decide, the Apple technologies it depends on, compatibility with future devices or iOS versions, updates or support will continue indefinitely. We may discontinue Decide as a whole, with the notice described in section 8.

Buying Lifetime does not cancel an existing Monthly or Yearly subscription; manage or cancel it in your Apple Account. In Decide 1.0, Family Sharing is not enabled for any plan.

7. Prices, refunds and your consumer rights

Prices and taxes are set and shown by the App Store and may differ by country or region. We do not handle your payment. Apple administers App Store refund requests; where Apple provides a statutory withdrawal process for App Store purchases in your country, you can use Apple’s purchase-history or refund tools. You can also contact us about Decide or about any right you have under consumer law. If a purchase is refunded or revoked, the access it unlocked ends.

Purchases belong to your Apple Account. On a new iPhone, or after reinstalling or resetting Decide, use Restore Purchases with the same Apple Account; restoring a purchase does not restore your configuration.

8. Changes to Decide, discontinuation, and changes to these Terms

We may change Decide over time — to improve it, keep it secure, comply with law or regulation, or keep it working with Apple’s platform — and may add, change or discontinue features. Section 6 limits what any change may do to an existing Lifetime purchase.

Where a change materially reduces what you have paid for, or we discontinue Decide, we will give you at least 30 days’ advance notice at getdecideapp.com and, where we can, in Decide. We may give less notice, or none, only where an urgent legal, security or Apple-platform change makes advance notice impracticable; we will then tell you as soon as we reasonably can.

We may update these Terms to reflect changes to Decide, the law or Apple’s requirements; the current version, with its effective date, is at getdecideapp.com. A change that materially and adversely affects your rights gets the same notice, and section 6 still applies to an existing Lifetime purchase.

9. Using Decide responsibly, and who can use it

You may use Decide on iPhones you own or control, as the Apple Standard EULA permits. You must not copy, modify, reverse engineer, redistribute, sell or sublicense Decide except where the law expressly allows it, interfere with its operation, circumvent platform restrictions, use it unlawfully or use it to infringe the rights of others. Decide, its software, design, branding and text are owned by or licensed to Douro Ventures.

Decide is intended for a general audience and is not specifically directed to people under 18. If you are under 18, or under the age of majority where you live, you need a parent or guardian’s permission to buy a plan.

10. Governing law, languages and contact

These Terms are governed by the laws of England and Wales. Nothing in these Terms limits any mandatory rights you have under applicable law, including the consumer laws of the country where you live and any rights about where a claim may be brought.

These Terms are available in English, Spanish and Brazilian Portuguese.
